Privacy Policy

Welcome to Swift Success (“Swift Success,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Swift Success website (swiftsuccess.org), platform, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions
“School” refers to any educational institution that registers for and administers a Swift Success account.
“Authorized User” refers to any staff member, teacher, administrator, student, or parent granted access to the Service by a School.
“Content” refers to any exams, questions, ebooks, courses, materials, or other data uploaded to the Service by a School or its Authorized Users.
“Platform Content” refers to any materials, templates, or resources provided by Swift Success itself.
2. Eligibility and Accounts

2.1 The Service is intended for use by registered educational institutions (“Schools”) and their Authorized Users.

2.2 Student accounts are created and managed by the School. Swift Success does not independently verify the age of individual students; the School is responsible for obtaining any necessary parental or guardian consent required by applicable law before providing student access to the Service.

2.3 Schools are responsible for maintaining the confidentiality of login credentials issued to their Authorized Users and for all activity that occurs under those accounts.

2.4 You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3. Description of Service

3.1 Swift Success provides a private, school-branded platform for creating and administering exams, ebooks, courses, and performance analytics, including simulations for exam boards such as WAEC, JAMB, IELTS, and SAT.

3.2 Each School’s data, Content, and Authorized User accounts are maintained in a private, isolated environment and are not shared with, or accessible by, other Schools using the Service.

3.3 We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

4. Subscription Plans and Payment

4.1 Access to the Service is provided under subscription plans (currently Basic, Advanced, and Premium), each with differing features as described on our Pricing page.

4.2 Subscription fees are billed on a recurring monthly basis unless otherwise agreed in writing. Prices are subject to change with prior notice.

4.3 Payments are processed through third-party payment providers (e.g., Paystack). Swift Success does not store your full payment card details.

4.4 Failure to pay applicable fees may result in suspension or termination of access to the Service.

4.5 Unless otherwise stated, subscriptions may be cancelled at any time, and cancellation will take effect at the end of the current billing cycle. Fees already paid are non-refundable except where required by law.

5. School Content and Ownership

5.1 Schools retain full ownership of all Content they upload to the Service, including exam questions, ebooks, courses, and any student performance data generated through use of the Service.

5.2 By uploading Content, the School grants Swift Success a limited, non-exclusive license to host, store, process, and display that Content solely for the purpose of operating the Service for that School.

5.3 Schools represent and warrant that they have all necessary rights and permissions to upload and use the Content they submit, and that such Content does not infringe upon the intellectual property or other rights of any third party.

5.4 Swift Success does not claim ownership of, and will not use, a School’s Content for any purpose other than providing the Service to that School, except as otherwise agreed in writing.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms;
Attempt to gain unauthorized access to another School’s account, data, or Content;
Upload Content that is defamatory, obscene, infringing, or otherwise unlawful;
Interfere with or disrupt the integrity or performance of the Service;
Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent.

We reserve the right to suspend or terminate access for any account found in violation of these provisions.

7. Intellectual Property

7.1 The Swift Success name, logo, platform design, software, and Platform Content are the property of Swift Success and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

7.2 School-uploaded Content remains the property of the respective School, as set out in Section 5.

8. Data Privacy

Our collection, use, and protection of personal data (including student data) is governed by our [Privacy Policy], which is incorporated into these Terms by reference. By using the Service, you also agree to the terms of our Privacy Policy.

9. Service Availability

9.1 While we strive to maintain high availability of the Service, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control.

9.2 We are not liable for any loss or damage arising from temporary unavailability of the Service.

10. Limitation of Liability

10.1 To the fullest extent permitted by applicable law, Swift Success shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10.2 Our total liability for any claim arising from these Terms or the Service shall not exceed the total fees paid by the School to Swift Success in the twelve (12) months preceding the claim.

10.3 Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

11. Termination

11.1 We may suspend or terminate a School’s access to the Service if these Terms are violated, if fees remain unpaid, or for any other reason with reasonable notice.

11.2 A School may terminate its account at any time by contacting us. Upon termination, we will provide a reasonable window for the School to export its Content before deletion, except where retention is required by law.

11.3 Sections relating to intellectual property, limitation of liability, and governing law shall survive termination of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
